If you do not agree with at least one of its provisions, you cannot enter into a Charger Rental Agreement.

 

Charger Rental Agreement(Public Offer)

 

Baku, January 1, 2025, Publication Date

This public offer (hereinafter referred to as the Offer) by the Lessor, whose name and details are specified in the Lessor's Details section, offers any individual who applies (hereinafter referred to as the User) to enter into a Charger Rental Agreement (hereinafter referred to as the Agreement) under the conditions specified below.

 

Terms and Definitions

 

1. Subject of the Agreement

1.1. The Lessor commits to providing a Charger to the User for temporary ownership and use upon the User's request, under the terms of this Agreement.
1.2. The Lessor grants the User free access to the Get Power Az application to facilitate the rental process.
1.3. This Offer includes the terms of the Framework Agreement. By accepting the Offer (as described in Section 2), the User enters into the Framework Agreement.
1.4. Additional details, such as rental process descriptions, pricing, discounts, technical requirements for the application, and other terms, are posted on the Website. These details form an integral part of the Agreement, which the User agrees to upon completing the actions described in Section 3.
1.5. The Lessor reserves the right to involve third parties in fulfilling the Agreement without the User's consent.

 

2. Acceptance of the Framework Agreement

2.1. To accept the Offer and enter into the Framework Agreement, the User must:

2.3. The User guarantees the accuracy and completeness of their provided information, including a valid email address, registered phone number, and bank card details.
2.4. The Lessor is not responsible for verifying the User's identity or the authenticity of personal or payment details provided.
2.5. In case of disputes about ownership of the provided data, the Lessor will rely on reasonable actions to ensure the legitimacy of the provided information.

 

3. Rules for Receiving, Using, and Returning Chargers

Locating a Vending Machine

3.1. Information about vending machine locations, working hours, Charger availability, and empty slots is available in the "Map" section of the User's Personal Cabinet.
3.2. The User must enable geolocation services and stable internet access on their device to ensure accurate information and select the correct Charger connector type.

Receiving Chargers

3.3. To rent a Charger, the User must follow the instructions provided in their Personal Cabinet or on the vending machine screen:

3.4. The User must inspect the Charger for functionality, intactness, and proper indicators within 5 minutes of retrieval.
3.5. If any defects are found, the User must immediately return the Charger to the vending machine and may request another one.
3.6. The rental period starts when the Charger is retrieved and ends when it is returned to the vending machine or when the order is closed via Support Service.

 

4. Payment Terms

4.1. The rental fee is determined based on the tariff specified for each vending machine and the selected rental period.
4.2. Tariff details, including prices per minute/hour/day, are displayed on the Website or vending machines. The Lessor may set a maximum rental fee for extended use.
4.3. The Lessor has the right to verify the User's bank card by reserving funds equivalent to the Charger’s value (89 AZN). If the Charger is returned undamaged within the trial period, no charges apply.
4.4. Payments are processed through E-Point. Users agree to the system's terms, including potential transaction fees, before completing payment.
4.5. All payments are debited from the User's registered bank card without requiring additional confirmation.

 

5. Duration of the Agreement

5.1. The Framework Agreement is entered into for an indefinite period.
5.2. The rental period (duration of Charger use) starts when the Charger is retrieved and ends when it is returned to the vending machine or when the order is closed via the Support Service.
5.3. Loss of the Charger by the User constitutes a breach of the Agreement, and the Lessor has the right to terminate the Framework Agreement and block the User’s access to their Personal Cabinet.

 

6. Rights and Obligations of the Parties

6.1. The User may change their email address or password by contacting the Support Service or through the Personal Cabinet.
6.2. The User must ensure the confidentiality of their login and password to the Personal Cabinet. If these details are lost or suspected of being compromised, the User must reset them or request the Support Service to block access. Failure to do so is the User’s responsibility.
6.3. The User must report any loss or damage to the Charger to the Lessor immediately (within one calendar day). If this obligation is not fulfilled, the Lessor has the right to demand compensation for the full value of the Charger, regardless of the reasons or circumstances.
6.4. The Lessor has the right to restrict the User’s access to the Personal Cabinet or terminate the Agreement if the User breaches its terms.
6.5. The Lessor may delegate the right to collect outstanding debts from the User to third parties without additional consent.

 

7. Liabilities of the Parties

7.1. If the User fails to fulfill or delays payment obligations, the Lessor has the right to impose a penalty of 1% of the outstanding amount for each day of delay.
7.2. In the event of damage or loss of the Charger, including alterations to its appearance, the Lessor has the right to charge a penalty of 89 AZN to the User’s bank card.
7.3. If the Charger is used for business or commercial purposes, the Lessor has the right to impose a penalty of 89 AZN.
7.4. The Lessor may continue charging rental fees until the Charger is returned or the order is closed. There is no maximum rental limit.
7.5. The Lessor is not responsible for damages caused to the User’s property or third parties due to improper use of the Charger.
7.6. By accepting the Offer, the User confirms they are the rightful owner of the phone number, bank card, and other provided details. Any risks related to incorrect information or unauthorized use are borne by the User.

 

8. Amendment Procedure

8.1. The Lessor reserves the right to amend or supplement the terms of the Framework Agreement and Agreement unilaterally without prior notice.
8.2. Users are encouraged to regularly review the Agreement for updates. If a User continues to use the Charger after updates are published, it constitutes acceptance of the new terms.

 

9. Dispute Resolution

9.1. Pre-litigation procedures are mandatory for resolving disputes.
9.2. The period for reviewing and responding to claims is 10 calendar days.
9.3. Claims must include sufficient information to identify the User, such as details provided during registration. Supporting documents, including copies of the User’s passport and payment receipts, must be attached.
9.4. Claims must be signed and submitted electronically or by registered mail to the Lessor's address.
9.5. If the claim submission procedure is not followed, the claim will be considered invalid.
9.6. If disputes cannot be resolved amicably, they may be referred to the courts located in the Lessor's jurisdiction, unless otherwise specified by consumer protection laws.

 

10. Miscellaneous Provisions

10.1. Documents exchanged via email or the Personal Cabinet are considered legally binding unless otherwise stated.
10.2. Messages sent via email or the Personal Cabinet are deemed received upon confirmation by the recipient’s system.
10.3. By accepting the Offer, the User consents to the processing of their personal data for the duration of the Agreement and for three years after its termination.
10.4. The User consents to receive promotional emails from the Lessor by checking the appropriate box during registration. The consent remains valid until the User opts out.
10.5. The User may opt out of promotional emails by clicking the "Unsubscribe" link in any email or notifying the Lessor via email.
